浅析老年人犯罪从宽处罚的法律依据

摘 要

人口老龄化越来越成为我国社会的主要问题，老年人违法犯罪也处于上升趋势，预防和减少老年人犯罪、遏制老年人犯罪上升势头刻不容缓。学者们普遍认为，对老年人犯罪适当从宽处理，不仅可以充分反映刑法的科学内涵，也是符合人道主义精神的，有利于彰显司法文明和法律伦理主义。《中华人民共和国刑法修正案(八) 》增加了对老年人犯罪从宽处罚的规定，这一规定表明了我国法律法规对老年人犯罪从宽处罚重视，是构建社会主义和谐社会的重要体现。也符合了自古以来我国“尊老爱幼”的优良传统的合理性要求。

本文通过对从宽处罚的内涵、体系以及老年人犯罪的特点进行了分析和理解，并从我国“矜老恤幼”的刑事法律传统、老年人刑事责任能力、刑法的谦抑性原则、刑罚目的性和宽严相济的刑事政策这几个方面分析和把握，表明了老年人犯罪从宽处罚的法律依据的正确性。并结合我国老年人犯罪情形对老年人犯罪从宽处罚制度做出了相关的策略和措施。

Abstract
